About Tomanzo
Tomanzo is a technology-based intermediary platform that connects Users with independent Providers offering various household, personal, professional, creative, technical, event, talent-based, and other services. Tomanzo does not directly provide, employ, manage, supervise, control, or perform the services offered by Providers listed on the Platform. All Providers available on the Platform are independent individuals or businesses and are not employees, representatives, agents, contractors, franchisees, joint venture partners, or affiliates of Tomanzo. The role of Tomanzo is limited to: • Providing a digital marketplace for User-Provider connections • Enabling booking requests and communication • Facilitating profile discovery and visibility • Sharing contact details after booking acceptance • Managing subscriptions and platform access • Maintaining platform operations and support services Once a booking request is accepted, Users and Providers may directly communicate regarding pricing, timelines, service requirements, payment methods, deliverables, negotiations and project terms. Tomanzo is not a party to any agreement entered into between Users and Providers.
Eligibility
To use the Platform, you must: • Be at least 18 years old • Possess the legal capacity to enter into binding contracts • Provide accurate and complete information • Comply with all applicable laws and regulations By using the Platform, you represent and warrant that you satisfy these requirements. If you are registering on behalf of a business or organization, you represent that you have authority to bind such entity to these Terms.
User Accounts
Users and Providers may be required to create an account to access certain Platform features. You agree to: • Provide true, accurate, and updated information • Maintain confidentiality of login credentials • Accept responsibility for all activities under your account • Notify Tomanzo immediately of unauthorized access or security breaches You are solely responsible for maintaining account security. Tomanzo reserves the right to suspend, restrict, verify, or terminate accounts that violate these Terms, applicable laws, or Platform policies.
Provider Verification
Providers may be required to submit verification documents, including but not limited to: • Government-issued identity proof • Address proof • Business or professional certificates • Portfolio content • Profile photographs • Police verification certificates (where applicable) • GST or tax-related information (if applicable) Tomanzo reserves the right to approve, reject, suspend, remove, or restrict any Provider profile at its sole discretion. Verification conducted by Tomanzo is limited in nature and does not constitute any guarantee, certification, endorsement, background clearance, or warranty regarding any Provider's identity, conduct, reliability, qualifications, professional capability, safety, or service quality. Submission of documents does not create any employment or contractual relationship between Tomanzo and the Provider.
Booking and Communication
Users may submit booking requests through the Platform. Providers may accept or reject booking requests at their sole discretion. Upon booking acceptance, contact details may be shared between Users and Providers for direct communication. Users and Providers may independently negotiate pricing, scope of work, timelines, payment methods, deliverables, and cancellation terms. Tomanzo is not responsible for negotiated pricing, service outcomes, delays or cancellations, miscommunication, failure to complete services, Provider or User conduct, or damages, injuries, or losses arising from services. All interactions and agreements between Users and Providers are solely their responsibility.
Payments and Subscription Model
Currently, Tomanzo does not process service payments between Users and Providers. Users pay Providers directly through mutually agreed methods including cash, UPI, bank transfer, wallets, or other offline methods. Tomanzo may charge subscription fees or promotional fees to Providers for Platform access, visibility, or premium features. Providers are solely responsible for payment collection, tax compliance, invoicing, financial reporting, GST obligations, record maintenance, and statutory compliance. Tomanzo shall not be liable for payment disputes, failed transactions, fraudulent payments, chargebacks, financial losses, or unauthorized transactions.
Subscription and Refund Policy
Certain Platform features may require paid subscriptions. By purchasing a subscription, Providers agree to pay all applicable charges and taxes. Unless otherwise stated: • Subscription fees are non-refundable • Partially used subscriptions are non-refundable • Promotional offers may be withdrawn at any time • Tomanzo may revise pricing at its discretion Continued use of the Platform after pricing changes constitutes acceptance of revised pricing. Refunds, if any, shall be provided solely at Tomanzo's discretion or where required under applicable law.
Provider Content and Media Uploads
Providers may upload profile photographs, portfolio images, videos and demo reels, talent showcase content, descriptions and biographies, social media links, certifications and documents. By uploading content, Providers represent and warrant that they own the content or possess necessary legal rights, the content does not infringe third-party rights, the content is lawful and accurate, and the content is not misleading, offensive, or defamatory. Providers grant Tomanzo a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, publish, display, distribute, promote, and use such content for Platform operations, advertising, marketing, social media promotion, business development, and related purposes. Tomanzo reserves the right to remove or restrict any content that violates laws or policies, is offensive or harmful, infringes intellectual property, or threatens Platform security or integrity.
Prohibited Activities
Users and Providers agree not to: • Use the Platform for illegal activities • Provide false or misleading information • Harass, threaten, or abuse others • Upload obscene, hateful, or offensive material • Violate intellectual property rights • Attempt unauthorized access • Use scraping tools, bots, or automation without permission • Engage in fraud or scams • Circumvent subscriptions or Platform systems • Impersonate individuals or entities • Distribute viruses, malware, or harmful code Violation may result in immediate suspension or permanent termination.
Independent Relationship
Providers are independent service providers. Nothing in these Terms creates employment, partnership, agency, franchise, or joint venture relationship between Tomanzo and any Provider. Providers decide whether to accept bookings, determine their pricing, control service performance, choose working hours, and manage taxes and legal compliance independently. Providers are not entitled to employment benefits, insurance, compensation, gratuity, PF, ESI, or similar benefits from Tomanzo.
Ratings and Reviews
Users may submit ratings and reviews regarding Providers. Reviews must: • Be genuine and truthful • Not contain abusive or defamatory content • Not violate laws or third-party rights Tomanzo reserves the right to moderate, remove, edit, or disable reviews at its discretion.
Intellectual Property
All Platform-related intellectual property including logos, branding, designs, source code, graphics, software, text, features, and user interface elements are owned by or licensed to Tomanzo and protected under applicable intellectual property laws. No content may be copied, reproduced, distributed, modified, reverse engineered, or commercially exploited without prior written consent.
Privacy
Use of the Platform is also governed by the Tomanzo Privacy Policy. By using the Platform, you consent to collection, processing, storage, and use of information as described in the Privacy Policy.
Third-Party Services
The Platform may use or integrate third-party services including Google Firebase, Google Maps, hosting providers, analytics tools, OTP and SMS providers, communication services, and cloud infrastructure providers. Tomanzo is not responsible for third-party systems, outages, policies, or actions. Use of third-party services may also be subject to their respective terms and policies.
Disclaimer of Warranties
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Tomanzo disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, reliability, security, accuracy, and compatibility. Tomanzo does not guarantee booking success, service quality, user satisfaction, identity verification accuracy, or continuous Platform availability. Use of the Platform is entirely at your own risk.
Limitation of Liability
To the maximum extent permitted by law, Tomanzo shall not be liable for indirect or consequential damages, loss of revenue or profits, data loss, personal injury, fraudulent conduct, service disputes, cyber incidents, unauthorized access, emotional distress, or property damage. Tomanzo's total liability shall not exceed the total subscription fees paid by the relevant Provider during the preceding six (6) months.
Indemnification
Users and Providers agree to indemnify and hold harmless Tomanzo, its directors, employees, affiliates, officers, and partners from any claims, liabilities, damages, losses, costs, or legal expenses arising from violation of these Terms, misconduct, service disputes, intellectual property infringement, violation of laws, or fraudulent activities.
Safety and Responsibility
Users and Providers are solely responsible for their communications, interactions, meetings, and transactions. Users are encouraged to independently verify Providers before hiring services. Providers are responsible for lawful and professional conduct. Offline meetings or transactions occur entirely at the parties' own risk. Tomanzo does not guarantee safety, conduct, or background verification unless explicitly stated.
Fraud Prevention and Monitoring
Tomanzo reserves the right to investigate suspicious activities or policy violations. Tomanzo may suspend accounts, restrict Platform access, remove content, report activities to authorities, and cooperate with law enforcement where legally necessary.
Suspension and Termination
Tomanzo may suspend, deactivate, restrict, or permanently terminate Platform access at its sole discretion, with or without notice, for reasons including violation of these Terms, fraudulent activities, harmful conduct, legal obligations, or non-payment of subscription fees. Termination shall not affect any legal remedies available to Tomanzo.
Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Any disputes arising from these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
Dispute Resolution
Before initiating legal proceedings, Users and Providers agree to attempt informal dispute resolution by contacting Tomanzo. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. • Seat of arbitration: Delhi, India • Language: English • Number of arbitrators: One (1) The arbitral award shall be final and binding.
Force Majeure
Tomanzo shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, government actions, internet failures, cyberattacks, strikes, power failures, technical disruptions, or pandemic situations.
Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Changes to Terms
Tomanzo reserves the right to modify or update these Terms at any time. Updated Terms become effective immediately upon posting on the Platform. Continued use of the Platform after updates constitutes acceptance of revised Terms.
Entire Agreement
These Terms, together with the Privacy Policy and any additional Platform policies, constitute the complete agreement between Users, Providers, and Tomanzo regarding Platform usage.
